论环境犯罪的构成要件
摘要：环境犯罪是刑法理论和刑事立法、司法领域的新型犯罪，近年来随着环境问题日益突出，有关环境方面刑法保护问题也逐渐为人们所关注。本文试从环境犯罪的概念、分类、环境犯罪构成中环境犯罪主体、主观方面、客体、客观方面以及主观方面是否应设立无过失责任以及因果关系认定原则等方面进行初步探讨，并提出了以环境刑事处置来解决环境犯罪的设想。
Abstract:The environment crime is the criminal law theory and the criminal legislation, the judicial domain new crime, day by day was in recent years prominent along with the environment question, the related environment aspect criminal law protection question also gradually paid attention for the people. This article tries from in the environment crime concept, the classification, the environment crime constitution the environment subject of crime, the subjective aspect, the object, the objective aspect as well as the subjective aspect whether should set up the non- error responsibility as well as the causal relation recognized aspect and so on principle carries on the preliminary discussion, and proposed handles by the environment criminal activity solves the environment crime tentative plan.
