监听的法治分析及本土架构
[摘要]：监听是刑事侦查机关为了查清案件事实而采取的一种科技侦查措施。它是一把双刃剑，以牺牲公民隐私权为代价来打击和惩罚犯罪。西方各国大多将监听纳入法治轨道，对监听做了详细的规定。本着对制度创新的关怀和变革法治的理想，有必要对监听法治化的机理进行考量, 并将国外的监听立法和本土资源相融合，以创造符合我国本土特色的监听范式。.

The nomocracy and construction of the monitor

Abstract: The monitor is a technology scout craft that criminal investigates find out the case facts. It attacks effectively to punish the crime at the cost of infringing upon the citizen rights of privacy seriously. Western countries bring monitor into the nomocracy orbit mostly and prescribe the detailed provision to the monitor. In the spirit of setting up a new system and transforming the nomocracy ,it is necessary to consider the theories foundation of the monitor，to combine the monitor lawmaking of oversea countries with the native resources and create a new monitor system type which matches our native characteristic .
